These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with the HoyMove mobile application and website (the "Service") operated by HoyMove Labs Ltd ("us", "we", or "our").
Please read these Terms and Conditions carefully before using our Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
By downloading, installing, accessing, or using the HoyMove mobile application or website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the Service.
You must be at least 13 years old to use the Service. While the Service is available to users aged 13 and above, HoyMove does not specifically target minors. If you are under 18 years old, you represent that you have obtained parental or guardian consent to use the Service.

To create and sell tickets for events through the Service, you must register as an Event Organizer. HoyMove reserves the right to verify your identity and may require additional information or documentation before allowing you to list events.
As an Event Organizer, you agree to:
Event Organizers agree to pay HoyMove a platform fee of 5% of all ticket sales processed through the Service. This fee will be deducted from the ticket sale proceeds before funds are transferred to the Event Organizer.
Customers purchasing tickets through the Service will be charged a service fee of 2% of the ticket price in addition to the ticket price. This fee is non-refundable and covers payment processing and platform maintenance costs.
Payments for tickets are processed through third-party payment processors, including Stripe and Paystack. By purchasing tickets, you agree to be bound by the terms and conditions of the applicable payment processor. HoyMove is not responsible for the actions or policies of these third-party payment processors.
No Refunds Through Platform: HoyMove does not process refunds for ticket purchases. All refund requests must be directed to the Event Organizer. HoyMove accepts no liability for refunds, ticket cancellations, or event changes.
If an event is cancelled, postponed, or significantly changed, you must contact the Event Organizer directly to request a refund or exchange. HoyMove is not responsible for refunding ticket purchases under any circumstances.

HoyMove is not responsible for any costs, damages, or losses incurred by Event Organizers or ticket purchasers due to event cancellations or changes.
We accept payments through Stripe and Paystack. Accepted payment methods may vary by region and are subject to the terms and conditions of the payment processors.
All prices are displayed in the currency specified by the Event Organizer. Currency conversion rates, if applicable, are determined by the payment processor and may vary.
As detailed in Section 5.3 and 5.4, Event Organizers pay a 5% platform fee, and customers pay a 2% service fee on all transactions. These fees are non-refundable.
If you have a dispute regarding a payment or transaction, you must contact the Event Organizer directly. HoyMove is not responsible for resolving payment disputes between users and Event Organizers.
If a chargeback is initiated against a transaction, HoyMove reserves the right to suspend or terminate the accounts of both the Event Organizer and the customer involved until the dispute is resolved. Event Organizers are responsible for any chargeback fees imposed by payment processors.
You retain ownership of any content you post, upload, or share through the Service ("User Content"). However, by posting User Content, you grant HoyMove a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with the Service.
You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that:
HoyMove reserves the right to remove, edit, or refuse to post any User Content that violates these Terms or is otherwise objectionable, in our sole discretion. We are not obligated to monitor User Content but may do so at our discretion.
The Service, including all content, features, functionality, and technology, is owned by HoyMove Labs Ltd and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.
"HoyMove", the HoyMove logo, and all related names, logos, product and service names, designs, and slogans are trademarks of HoyMove Labs Ltd. You may not use these marks without our prior written permission.
Your use of the Service is also governed by our Privacy Policy, which can be found at https://hoymove.com/legal/privacy. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.
We may share your information with third-party payment processors (Stripe and Paystack) as necessary to process transactions. These third parties are subject to their own privacy policies and terms of service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
HoyMove is not responsible for the quality, safety, or legality of events listed on the Service. We do not endorse any Event Organizer or event. You attend events at your own risk. HoyMove is not liable for any injuries, damages, or losses that occur at events.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HoyMove LABS LTD, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
The Service may contain links to third-party websites or services, including payment processors. We are not responsible for the content, privacy policies, or practices of third-party services. Your interactions with third-party services are solely between you and the third party.
You agree to indemnify, defend, and hold harmless HoyMove Labs Ltd, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

If you are an Event Organizer, termination does not affect your obligations to ticket purchasers, including refund obligations.
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before initiating any legal proceedings, you agree to first contact us at legal@hoymove.com to attempt to resolve any disputes informally. If we cannot resolve a dispute within 60 days, either party may proceed with legal action.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HoyMove Labs Ltd regarding the Service and supersede all prior agreements and understandings, whether written or oral.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights or obligations hereunder without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction.
We shall not be liable for any failure or delay in performance under these Terms which is due to fire, earthquake, flood, act of God, act of war, terrorism, epidemic, pandemic, internet failure, or any other cause beyond our reasonable control.
